Compliance Program Development
Export Compliance Services will travel to your business locations to analyze your business practices in relation to relevant export regulations. Export Compliance Services will design a compliance program tailored to your specific needs or improve your existing program with processes and procedures that will minimize your risk of export violations.
Training Programs
Through individual instruction or by seminar, Export Compliances Services will provide training to your staff on all aspects of export compliance. Export Compliance Services will help you develop a training program that is comprehensive and easily understood by your employees. This training will explain how your products and technologies are subject to the regulations, as well as help your employees understand their responsibilities under the ITAR and EAR regulations.
Audits
As an exporter, it is necessary that your company be ready for any external audit that may be conducted by the United States government. To assure your readiness for such an audit, Export Compliance Services will conduct an internal assessment of your compliance program, make recommendations for improvements, as well as assist in implementation of the improvements.
Product Classification
Export Compliance Services will help your company classify your products and technologies by working with your engineering and/or technical experts. Export Compliance Service also has expertise in the United States government request for commodity classification process. Export Compliance Services will work with your IT support personnel to help you set up systems for storing classifications.
Licensing
Your controlled products and technology may require export authorizations from the United States government prior to exporting. Export Compliance Services has expertise in acquiring licenses through the U.S. Department of State and the U.S. Department of Commerce, as well as the Office of Foreign Asset Controls. Export Compliance Services will assist your licensing efforts by working closely with company product experts to develop license applications for approval by our government.
Foreign Person Management/“Deemed Export Rule”
Under the “deemed export rule,” providing controlled technology to a foreign person is “deemed” to be an export to that person’s country of citizenship. Generally, the rule applies to employees, contingent workers, and visitors. If you have foreign persons at your business, it is important to understand how our export regulations affect your ability to have the foreign persons perform certain tasks. Export Compliance Services will help you develop control plans to enable you to hire foreign persons and ensure compliance with the regulations.
Commodity Jurisdiction Process
Export Compliance Services has extensive experience in the commodity jurisdiction process under the ITAR. Export Compliance Services will work with your engineers and/or technical experts to complete the commodity jurisdiction process for products currently under ITAR control.
Merger and Acquisition Due Diligence
If your company is moving toward merger or acquisition of another company, it is imperative that the export compliance program of the company be reviewed as part of the due diligence process. Export Compliance Services will provide guidance and assess risk in support of your due diligence efforts.
Shipping
With the inception of the required Automated Export System, the risk for inadvertent export violations has increased. Export Compliance Services will work with your shipping department personnel and your freight forwarders to reduce risk of violations when shipping physical product or technologies.
Investigations
If your company suspects that an export violation has occurred, it is important to conduct an investigation, determine the facts, and establish whether or not your compliance program failed. Export Compliance Services will investigate suspected violations, identify mitigating circumstances if a violation has occurred, and provide assistance in process improvement to avoid future violations.
Voluntary Disclosure Process
If your company violates an export regulation, you must determine whether or not a voluntary disclosure should be made to the government. From investigation through voluntary disclosure filing, Export Compliance Services will work with you and/or your legal representatives to determine the appropriate course of action to take.
